Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and ItWorksinUA ("we", "us", "our"), the operator of the Rent My Spot mobile application and website (collectively, the "Service"). By registering an account or using the Service in any way, you confirm that you have read, understood and accepted these Terms.

2. The Service

Rent My Spot is a peer-to-peer marketplace that allows property owners ("Hosts") to list their parking spots, driveways, garages and storage spaces, and allows other users ("Renters") to discover and contact Hosts directly. Rent My Spot acts solely as a technology platform and is not a party to any agreement between Hosts and Renters. We do not own, manage or control any listed spaces.

3. Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
• You must have the legal right and authority to list a space (either as the owner or with the explicit permission of the owner).
• By using the Service you represent and warrant that you meet these requirements.

4. Accounts

To access most features you must create an account using a valid phone number. You are responsible for:

• Maintaining the security of your account. Do not share your OTP codes with anyone.
• All activity that occurs under your account.
• Notifying us immediately at support@rentmyspot.io if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Listing Rules for Hosts

If you list a space on Rent My Spot, you agree that:

• All information in your listing (address, dimensions, price, availability, photos) is accurate, current and not misleading.
• You have the legal right to rent out the space (ownership, lease permission, local authority licence where required).
• You will not list a space that is unsafe, inaccessible or does not match its description.
• You are solely responsible for complying with any local laws, regulations, HOA rules or lease agreements relating to subletting or renting your space.
• You will honour confirmed arrangements made through the app in good faith.
• You will not demand payment through channels outside the app in order to circumvent the platform.

6. Rules for Renters

If you rent a space through Rent My Spot, you agree that:

• You will use the rented space only for the purpose and during the period agreed with the Host.
• You will not damage the space or surrounding property. You are liable for any damage you cause.
• You will not block access to the property beyond the agreed boundaries.
• You will vacate the space promptly at the end of the agreed rental period.
• You are solely responsible for ensuring that your vehicle or stored items comply with local regulations.

7. Prohibited Conduct

You must not:

• Post false, misleading or fraudulent listings.
• Harass, threaten or abuse other users.
• Use the Service for any illegal purpose, including money laundering or fraud.
• Scrape, crawl or otherwise extract data from the Service without our express written permission.
• Attempt to reverse-engineer, decompile or interfere with the app or its infrastructure.
• Use automated scripts or bots to interact with the Service.
• Impersonate another person or organisation.
• Upload content that infringes any third party's intellectual property, privacy or other rights.

Violation of these rules may result in immediate account suspension and, where appropriate, reporting to law enforcement.

8. Payments & Fees

Rent My Spot currently operates on a zero-commission model. Renters contact Hosts directly and all payment arrangements are made between the parties without involvement from us.

We are not responsible for payment disputes, non-payment or any financial loss arising from transactions between users. Users are encouraged to agree terms in writing before committing to a rental arrangement.

We reserve the right to introduce fees or a payment-processing feature in the future. We will notify users at least 30 days in advance of any such change.

9. Intellectual Property

All rights in the Rent My Spot name, logo, app design, source code and original content belong to ItWorksinUA. You may not reproduce, distribute or create derivative works without our written permission.

By submitting content to the platform (listing photos, descriptions, etc.) you grant us a worldwide, royalty-free, non-exclusive licence to display and use that content solely for the purpose of operating and promoting the Service. You retain ownership of your content.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free or secure.
• Any listing is accurately described or that any space is safe, legal or suitable for your needs.
• Any User is who they claim to be.

You use the Service at your own risk. We strongly recommend that both Hosts and Renters take appropriate precautions (e.g. verify identities, inspect spaces before renting, use written agreements).

11. Limitation of Liability

To the maximum extent permitted by applicable law, ItWorksinUA and its officers, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed €100 or the amount you have paid us in the 12 months preceding the claim, whichever is greater.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Termination

You may close your account at any time via the in-app settings. We may suspend or terminate your account immediately, without notice, if you breach these Terms or if we are required to do so by law.

Upon termination, your right to use the Service ceases immediately. Sections 9, 10, 11 and 13 of these Terms survive termination.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of Ukraine (or the applicable EU member state law where mandated by consumer protection regulations). Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Ukraine, unless a mandatory consumer protection law in your country of residence provides otherwise.

If you are a consumer in the EU, you may also use the EU Online Dispute Resolution platform.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via an in-app notification at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, please close your account before the effective date.
